Terms of Service

1. Acceptance
By accessing or using OpenView, you agree to be bound by these Terms and the Privacy Policy. If you do not agree, stop using the service.
2. Accounts and Eligibility
You must provide accurate information and protect your credentials. You are responsible for all activity under your account.
3. Service Scope
OpenView provides JD extraction, resume analysis, role matching, interview question generation, report export, and related job-preparation features.
4. User Content and License
You retain rights to uploaded content (JDs, resumes, text). You grant OpenView the necessary license to process, store, and analyze such content for service delivery.
- You must have the legal right to upload and process the content.
- Do not upload illegal, infringing, or clearly malicious content.
5. JD and Resume Analysis Notice
OpenView outputs are generated through algorithmic/model inference for job-preparation support only, and do not guarantee interview or hiring outcomes. You remain responsible for final decisions.
6. Plans, Credits, and Limits
Different plans include different credits, feature entitlements, and usage limits. Certain actions may be limited based on subscription state, quotas, and anti-abuse controls.
7. Subscription and Auto-renewal
Subscriptions are processed by Stripe and may auto-renew. Billing cycle, renewal amount, and taxes are governed by checkout details and Stripe invoices.
8. Cancellation, Downgrade, and Refund Policy
You may cancel before renewal; benefits generally continue until the end of the current billing period. Downgrades are applied according to system effective-date rules.
- Unless required by law or explicitly stated at checkout, paid subscription fees are generally non-refundable.
- One-time credit top-ups are generally non-refundable once credits are granted.
- For duplicate charges, unauthorized payments, or billing anomalies, contact support@openview.works promptly with payment evidence.
- Where applicable law provides statutory withdrawal rights, cooling-off periods, or mandatory refunds, we will comply with those legal requirements.
9. Acceptable Use
You may not perform unauthorized scraping, malicious automation, auth bypass, reverse attacks, API abuse, or use outputs for unlawful purposes.
10. Intellectual Property
OpenView platform assets, UI, code, and non-user content are owned by OpenView or its licensors. You may not copy, sell, or redistribute platform materials without permission.
11. Disclaimer and Limitation of Liability
The service is provided on an “as is” and “as available” basis. To the extent permitted by law, OpenView is not liable for indirect damages, lost opportunity, or business interruption.
12. Suspension and Termination
If you violate these Terms, pose security risks, or abuse the service, we may suspend or terminate access and retain audit records when necessary.
13. Governing Law and Disputes
These Terms are governed by the laws of the Hong Kong SAR. Parties should first attempt good-faith resolution; unresolved disputes may be submitted to competent courts or arbitration as applicable.
14. Changes to Terms
We may update these Terms due to business, technical, or legal changes. Continued use of the service indicates acceptance of the updated Terms.
